Distance Sales Agreement

1. PARTIES

This Agreement is entered into between the following parties under the terms and conditions set forth below:

By accepting this Agreement, the Buyer acknowledges that, upon confirming the order, they undertake to pay the Product price and any applicable shipping fees, taxes or other charges, and that they have been informed thereof in advance.

2. DEFINITIONS

In this Agreement, the following terms shall have the meanings set out below:

  • MINISTRY: The Ministry of Customs and Trade.

  • LAW: Law No. 6502 on Consumer Protection.

  • REGULATION: Regulation on Distance Contracts.

  • SERVICE: Any consumer transaction other than supply of goods, provided in exchange for a fee or benefit.

  • SELLER: The company offering goods under its commercial or professional activities.

  • BUYER: A natural or legal person who acquires, uses or benefits from goods or services for non-commercial purposes.

  • SITE: The Seller’s website.

  • ORDERER: The natural or legal person who places an order via the Site.

  • PARTIES: The Seller and the Buyer.

  • AGREEMENT: This Distance Sales Agreement.

  • GOODS: Movable items subject to purchase, including software, audio, video, and other digital goods.

3. SUBJECT

This Agreement governs the sale and delivery of the Products listed below—whose description and sale price are set out on the Site—pursuant to Law No. 6502 and the Regulation on Distance Contracts. All prices are in U.S. Dollars (USD). Quoted prices remain valid until updated; promotional prices apply only for the stated period.

7. PRODUCT INFORMATION

  1. Description: The basic features (type, quantity, brand/model, color, etc.) of each Product are published on the Site. Campaign-specific details apply only during the campaign period.

  2. Prices: All listed prices are sale prices, inclusive of any VAT. Prices remain valid until changed. Timed offers expire at the end of the stated period.

  3. Taxes & Payments: The total price—including all taxes—is shown at checkout, in USD.

The invoice will be delivered together with the order to the invoice address at the time of delivery.

9. GENERAL PROVISIONS

  1. Information & Consent: The Buyer declares having read and accepted the Product’s features, sale price, payment method, and delivery information on the Site and has given all necessary electronic confirmations.

  2. Delivery Time: Products will be delivered within the period indicated on the Site’s information page, not to exceed 30 calendar days, subject to the Buyer’s location.

10. RIGHT OF WITHDRAWAL

For sales of goods, the Buyer may withdraw from this Agreement—without giving any reason—within 14 days of delivery by notifying the Seller in writing.

11. EXCEPTIONS TO WITHDRAWAL

The Buyer’s right of withdrawal does not apply to goods made to the Buyer’s specifications, underwear, cosmetics, disposable items, or other products exempt by law.

12. DEFAULT & LEGAL CONSEQUENCES

If the Buyer pays by credit card and defaults, they accept liability for any interest or fees charged by their bank under the bank’s credit card agreement.

13. JURISDICTION

Disputes arising from this Agreement shall be submitted to the Consumer Arbitration Committee or Consumer Court in the Buyer’s place of residence or where the transaction occurred.

14. EFFECTIVE DATE

This Agreement enters into force when the Buyer completes payment for the order on the Site.
